Travel agent: here are the new conditions for access to the profession

Decree 2.21.80 relating to Law 11.16 determining the procedures and terms for obtaining travel agent licenses was published in the Official Bulletin of 1 September. Here are the highlights. Decree 2.21.80 relating to law 11.16 concerning the organization of the travel agent profession was published in the Official Bulletin of 1 September. Adopted by the government last April, the decree determines the procedures and terms for obtaining and operating travel agent licenses. In detail, the application for a travel agent license is done online. The applicant must, in fact, complete a form available on the website of the Ministry of Tourism. He must then scan the original documents required and attach them to the completed form. Note that the documents required differ depending on the type of license requested. • To obtain an organizer-distributor type travel agent licence, the company's articles of association must be filed. The natural person who proposes to manage the agency must issue either the national electronic identity card or the residence permit in Morocco with the diplomas and certificates obtained during his or her career. • With regard to the distributor-type travel agent licence, the applicant (natural person) must present his CINE, his diplomas and certificates. The articles of association must also be presented. The person who proposes to lead must also issue either the national electronic identity card or the residence permit in Morocco with the diplomas and certificates obtained during his or her career. Regardless of the type of license requested, the applicant must certify via the platform that the information provided by him is correct. As soon as the first steps are completed, a receipt is given to the applicant. The latter is required to file this receipt with an extract from the criminal record with one of the departments affiliated with the Ministry of Tourism, within a maximum of 5 days. He will then receive his “file submission receipt”. If he misses the deadline, his request risks being cancelled. Important clarification: The diplomas and certificates are determined by article 5 of the law. Any person who proposes to manage the travel agency of the organizer-distributor type must meet one of the following conditions:• A diploma or equivalent attesting that the person has completed 5 years of study in one of the higher education establishments, whether public or private. • A diploma or equivalent proving that the person has completed three years of higher education, whether public or private. In this case, the applicant must have a certificate issued by a natural or legal person attesting to at least 2 years' experience, either in the tourism sector or in business management.• A diploma or equivalent of two years of study in one of the public or private higher education establishments, with a certificate of 3 years of experience in the tourism sector or in business management.• The baccalaureate certificate with an attestation of at least 5 years in the tourism sector or in business management.For a natural person who applies for a distributor-type travel agent license, or one who proposes to manage the agency of the same type:• A diploma or equivalent of two years of higher education, at least, issued by one of the public or private establishments.• A technician's diploma issued by one of the vocational training establishments, whether public or private, with at least the baccalaureate certificate.• A baccalaureate certificate with proof of two years of experience in the tourism sector or in business management. After receipt of the file, a representative of the external services of the Ministry of Tourism proceeds to its investigation. It should be noted that if the file submitted is not complete, the applicant is notified by email to provide the missing documents. On the other hand, if everything is in order, the applicant obtains the agreement in principle which is granted to him electronically. He must then deposit the necessary financial or bank guarantee while proving that he has taken out insurance. These documents must be submitted within a maximum of 30 days to one of the departments of the supervising ministry. It should be noted that the amount of the financial or bank guarantee is fixed at 200,000 DH whether for the agent license of the organizer-distributor type or that of the travel distributor type. The amount must be deposited in cash in the Caisse de depot et de gestion. Notwithstanding the requirements of Article 5, the Ministry of Tourism may, on a transitional basis, for a period of 24 months from the date of entry into force of this decree:- Awarding a travel agent license of the organiser-distributor or distributor type to legal persons who offer managers attesting to a minimum of 7 years' experience in the sector, before the entry into force of this decree; – Assign a travel agent license of the type of distributor for autonomous legal persons with experience of at least 7 years in a licensed travel agency. The application of this decree is entrusted to the Minister of Tourism, Crafts and Social Economy and Solidarity. It will enter into force three months after the date of its publication, ie in the month of December.
